Hume council has begun enforcement proceedings in the Victorian Civil and Administrative Tribunal (VCAT) in regard to earthworks on land at Riddell Road, Sunbury, that are in contravention of the council’s Planning Scheme.
Planning schemes include policies and provisions that control land use and development, and they are made up of maps and ordinance. Ordinances are the policies and written clauses, and maps depict where zones and overlays apply within a planning scheme area.
In a media release published by Hume on August 9, it said that the council “recognises that the ongoing works could pose a significant risk to the environment and the community,” and that it has “commenced these proceedings as a means of ensuring that any immediate risk is swiftly and appropriately managed.”
Additionally, as part of these proceedings, the council applied for an interim enforcement order to cease the works and have them not recommence until the matter is determined.
The council said that it also applied for an enforcement order requiring the occupier of the land to rehabilitate it as far as practicable to its condition before the unlawful works commenced.
Hume is set to provide a further update once the VCAT process is complete.
